Greetings fellow Constitutionalists! And good news abounds from the Constitution Party of Wisconsin!!

Once again we have prevailed over the State Elections Board, bringing closure to our lawsuit filed almost one year ago.

To refresh your memory, during last years fall election we had two candidates disqualified from ballot access because signatures gathered on their petitions were from out-of-district petitioners.

The "law", as it read, prohibited petitioners from outside the jurisdiction of the office from gathering signatures for an otherwise legitimate candidate. This "law" had been ruled unconstitutional in other states and we challenged it here in Wisconsin.

Several months ago District Judge Barbara Crabb ruled that the State Elections Board violated the First Amendment rights of John Clark and Michael Schultz by refusing to accept valid signatures because they had been gathered by out-of-district petitioners.

The ruling was a tremendous victory, not only for us but for everyone wanting to run for office in this State. However, the SEB would not let the issue rest and contended that our legal fees were too high and requested a ruling on how much they should pay our attorneys.

Our legal team had kept accurate and detailed records of how much time was spent preparing for and trying the case. By requesting the second ruling from Judge Crabb the SEB effectively cost the taxpayers of Wisconsin, that's you and me folks, an additional 30% as our lawyers had to "prove" that their initial bill was a fair one. The additional time to prove that is what increased the bill and cost us more money. Thank you Madison.


Our thanks once again to all who were involved, especially Attorney Robert G. Bernhoft and his team for their diligence and hard work. It paid off in the end and the citizens of the State of Wisconsin are better off because of their efforts.

On to other news, this will be my last letter to you. As I've mentioned in previous letters I cannot continue as State Chairman. My time is stretched too thin between family, my job and other commitments, to be an effective Chairman. I have thoroughly enjoyed serving these past two years and look forward to a point in my life when I can dedicate more time to restoring Biblically based, constitutionally limited government on your behalf.

I hope to continue serving on the State Committee in a different capacity, which brings me to the next point. Enclosed you will find the annual Call to Convention letter. I won't go into details here because they are covered in the enclosure. Please be sure to read it and make your reservations early. We have not confirmed the evening Keynote speaker yet, but the short list of names will be worth the investment for your attendance. I look forward to seeing you there.

The next National Committee meeting will be held in the Detroit, Michigan area this coming November 6-8. Since this is so close for us in Wisconsin I would like to encourage each of you reading this to consider attending. It is a great opportunity to meet like-minded CP-er's from around the nation. He truly does inspire the best in all of us.
